Defective Drug Lawsuits

A product liability or defective product claim for a pharmaceutical drug is based on the following:

Are pharmaceutical drugs approved by the U.S. Food and Drug Administration (FDA) before they can be prescribed to patients?

Yes. However, approval by the FDA does not by itself mean any particular drug is safe. Even if certain serious side effects and complications are found to arise from a drug after testing, the FDA may still approve the drug as long as the dangerous side effects do not occur too often. Unfortunately, only after a drug is approved for use, dangerous side effects are discovered to be more prevalent than originally determined during the FDA approval process. Many FDA approved drugs have been recalled and/or reclassified after consideration of reports of severe injury to patients using these drugs.

Do I have to prove a defective drug has caused my injuries?
